SKINNYFIT SMS TERMS AND CONDITIONS

SkinnyFit may modify these Terms from time to time with or without notice to you. Modifications will be effective as of the date they are posted on this page and shall supersede any prior terms. Your continued use of the Mobile Services following the effective date of any such change(s) shall constitute your acceptance of such change(s).
1. Opting into Mobile Services
Once you provide your consent to receiving SMS or text messages from and on behalf of SkinnyFit, you will receive SMS or text messages from SkinnyFit through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call List. These messages may be sent using an automated telephone dialing system or similar technology. You understand and agree that you do not need to sign up for the Mobile Services in order to make a purchase and your consent is not a condition of any purchase with Skinny Fit as your participation in the Mobile Services is completely voluntary.
2. Cost of Mobile Services
We do not charge you for receiving the Mobile Services, but please note that your mobile carrier’s normal messaging, data, and other rates and fees may apply to your use of the Mobile Services. Any charges from your mobile carrier are governed by your mobile carrier’s policies and not by our terms. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider. If you have any questions about your text message plan, please contact your wireless provider.
3. Opting out of Mobile Services
If you no longer wish to receive the Mobile Services, you may opt-out at any time by texting “STOP” in response to the message you receive. You may receive a one-time opt-out confirmation message but no further messages will be sent to your mobile device unless you opt-in again. You may also text “HELP” in response to the message you receive to get more information, support, or assistance.
4. Access to Mobile Services
In order to receive the Mobile Services, you must have a mobile communications subscription with a participating carrier and it is your responsibility to ensure that your mobile carrier supports text messaging. The wireless carriers supported by the Mobile Services are not liable for delayed or undelivered messages. SkinnyFit reserves the right to modify, suspend, limit the use of, discontinue, or permanently cancel all or any portion of the Mobile Services. To the extent permitted by applicable law, you agree that SkinnyFit will not be liable for failed, delayed, or misdirected delivery of information sent through the Mobile Services, any errors in such information, and/or any action you may or may not take in reliance on the information or Mobile Services.
5. Your Telephone Number
By opting into the Mobile Services, you represent that you are 18 years of age or older. You further represent that you are the current account holder or authorized user for the mobile telephone number(s) that you enroll. In the event you change your telephone number, you agree to notify SkinnyFit immediately by contacting us at 888.862.1758. You agree to indemnify, defend, and hold harmless SkinnyFit for all claims, expenses, and damages related to or caused in whole or in part by (a) your failure to notify SkinnyFit if you change, forfeit, or deactivate your telephone number; or (b) you providing SkinnyFit with an inaccurate or invalid telephone number.
